Terms of Service

Canada-first Terms that apply worldwide — core rules for everyone, with extra notes for other regions (similar in layout to large global platforms). Have a lawyer review before treating them as final.

1. Our service

GearNet is an automotive social network operated from Canada and available worldwide at gearnetapp.com and through our mobile apps (the “Service”). These Terms of Service form a contract between you and GearNet. By creating an account or using GearNet, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Who these Terms apply to

These Terms apply to everyone who uses GearNet, wherever you live. They are written primarily for Canadian law, but are intended to work for users around the world. If the mandatory laws of your country or region give you rights that cannot be waived, those rights still apply and prevail over conflicting parts of these Terms. Additional rules for certain regions appear in Section 21.

3. Eligibility

You must be at least 13 years old to use GearNet (or older if the law where you live requires a higher age). If you are under the age of legal majority where you live, you may use the Service only with a parent or guardian’s consent, and they agree to these Terms on your behalf. You must have the legal capacity to enter this contract.

4. Your account

You can sign up with email and password or with a phone number and one-time code. Keep your login details accurate and secure. You are responsible for activity on your account. You can delete your account anytime in Settings; we remove your profile and related data from the live Service as described in the Privacy Policy.

5. What GearNet provides

GearNet lets you share vehicles and builds; post to Explore (photos, video, audio, and short-lived Pit Updates); follow people; join clubs; find and RSVP to meets; message others; list parts or vehicles on Exchange; log maintenance on Service Bench; and use tools like manuals search, recalls lookup, collections, and referrals. We may change or discontinue features. Some extras (Pro garage links, boosts, verified seller/shop badges) may be limited, experimental, or free unless we clearly offer a paid product.

6. Your content

You own the content you create on GearNet (“User Content”) — including posts, Pit Updates, comments, reactions, media, vehicle and mod records, build and maintenance logs, club and event materials, meet pins, listings, trade offers, messages, and collections. You grant GearNet a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, and distribute that content only as needed to run, secure, and improve the Service (feeds, profiles, search, notifications, backups, moderation). You confirm you have the rights to share your User Content and that it does not break the law or others’ rights.

7. Acceptable use

Do not: post illegal, hateful, harassing, sexually exploitative, fraudulent, or infringing content; spam, scrape, or attack the Service; impersonate others; misuse someone’s personal information; list stolen, unsafe, or illegal goods; abuse reports or verification; or bypass safety controls. We may remove content or suspend accounts that break these rules or harm the community.

8. Clubs, meets & location

Social and community features (follows, clubs, challenges, RSVPs, check-ins, convoy location, parking zones, and similar) are for organizing with other builders. Club dues and event ticket prices or external ticket links are information only — GearNet does not take those payments. If you share location for meets or maps, others may see it as the feature describes. Use location features carefully.

9. Exchange (marketplace)

Exchange connects buyers and sellers. GearNet is not the buyer or seller, does not hold money, and does not process payments. “Escrow,” buyer-protection, trade-offer, and shipping-status tools only track status — they do not move funds or guarantee a deal. Prices are whatever users enter (often CAD or local currency). You are responsible for listings, taxes, local law, and safe meetups. Consumer-protection laws where you live may still apply. Deal carefully and at your own risk.

10. Service Bench & vehicle data

Maintenance tools, manuals, VIN lookups, and recalls may use third-party or government data (including sources outside your country). Information can be incomplete or outdated and may not match local official notices. GearNet is not professional mechanical advice. Double-check safety recalls through official channels where you live.

11. Messages & notifications

We may send account and security messages needed to run the Service. Optional emails, digests, and push alerts follow your settings. In Canada, commercial electronic messages also follow CASL (consent and unsubscribe). Elsewhere, we follow local marketing and spam rules. You can change notification preferences in Settings or unsubscribe where we provide a link.

12. Moderation

You can block and report people or content. We may review reports and take action we think is appropriate (including removing content or restricting accounts). We do not promise a specific outcome. You may still contact regulators or police if needed.

13. Our intellectual property

GearNet’s name, branding, and software belong to us or our licensors. These Terms do not give you rights to copy or exploit that IP, other than using the Service as allowed.

14. Third-party services

GearNet may link to other sites or apps (maps, ticket pages, and similar) and uses service providers listed in our Privacy Policy. Their terms and privacy practices apply to them. We are not responsible for third-party services.

15. Disclaimers

To the fullest extent allowed by law where you live, the Service is provided “as is” and “as available,” without warranties of any kind (including merchantable quality, fitness for a purpose, and non-infringement). We do not guarantee uninterrupted or error-free service, or that content or vehicle/marketplace data is accurate. Some places do not allow certain disclaimers; there, only the disclaimers that are allowed apply.

16. Limits on liability

To the fullest extent allowed by law where you live, GearNet will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill, from your use of the Service or deals with other users. Except where the law says we cannot limit liability (for example certain consumer rights), our total liability for claims about the Service is limited to the greater of CAD $100 (or the equivalent in your local currency) and any amount you paid us for the Service in the 12 months before the claim.

17. Indemnity

To the extent allowed by law, you will indemnify GearNet against claims and costs arising from your User Content, your use of the Service, your marketplace or meet activity, or your breach of these Terms or the law.

18. Ending the Service for you

You may leave and delete your account anytime. We may suspend or end access for breaches, fraud, legal reasons, or to protect users. Parts of these Terms that should survive (including licences already used to operate the Service, disclaimers, liability limits, and indemnity) continue after termination.

19. Changes

We may update these Terms. We will change the “Last updated” date and, for material changes, give extra notice when required (for example in-app or by email). If you keep using GearNet after changes take effect, you accept the new Terms where the law allows. If you do not agree, stop using the Service and delete your account.

20. Governing law (Canada first)

These Terms are governed by the laws of Canada and the Province of Alberta, except where mandatory laws of your place of residence say otherwise. Try to resolve disputes by emailing kachurtaylor5@gmail.com first. Subject to mandatory local consumer protections, courts in Alberta (and Canadian federal courts sitting there) have non-exclusive jurisdiction. If our principal place of business is confirmed in another Canadian province, we may update this section after legal review. For users outside Canada, see also Section 21.

21. Additional terms by region

Canada: Mandatory provincial consumer-protection and privacy rules that cannot be waived still apply. Québec consumers: if we provide a French version, Québec law may require the French text to prevail for you; otherwise these Terms are offered in English. European Economic Area, UK, and Switzerland: nothing in these Terms limits non-waivable consumer rights under local law; disputes may be brought in your local courts where the law requires. United States and other countries: local consumer, warranty, and product rules may give you rights these Terms cannot remove; where a waiver or limitation is not allowed, it is modified to the minimum extent needed. Export and trade: you must not use the Service in violation of Canadian, U.S., or other applicable export or sanctions rules.

22. Language & general

These Terms are provided in English. Translations are for convenience unless local law (including Québec) requires otherwise. If one part of these Terms is unenforceable, the rest remains in effect. Failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them if the Service is transferred. These Terms, the Privacy Policy, and any feature-specific terms are the whole agreement between you and GearNet about the Service.
